The Supreme Court highlighted that arrests should only be made during the investigation when necessary. It criticized the unusual practice in Uttar Pradesh where arrests are made after a chargesheet is filed. The court stressed that once the investigation is complete, the accused should be asked to appear before the court and granted bail.
